Terms and conditions

LushyChat provides browser-based random video chat and related features as we make them available from time to time. We may modify, suspend, or discontinue any part of the service with or without notice, except where applicable law requires otherwise.

You are responsible for your own internet connection, device, and any fees charged by third parties (such as mobile data providers).

You must be at least 18 years of age to use LushyChat. Anyone who has not reached 18 is not allowed on the platform. Where local law sets a higher minimum age for services like this, you must meet that age as well.

If we discover, reasonably believe, or are notified that you are under 18, we may immediately suspend or terminate your access, ban your account and devices, and take other enforcement steps we consider appropriate—without prior notice where permitted by law.

If you are using LushyChat on behalf of an organization, you represent that you have authority to bind that organization.

You agree not to:

• Harass, threaten, defraud, or harm other users, or encourage others to do so.
• Share illegal content, including sexual content involving minors, non-consensual intimate imagery, or content that violates intellectual property rights.
• Attempt to interfere with or disrupt the service, other users, or our infrastructure—including probing, scraping, or circumventing security measures without authorization.
• Use the service to send spam, phishing, malware, or to build unauthorized databases of user information.
• Misrepresent your identity in a way that is likely to deceive others in connection with harm or fraud.

We may investigate violations and take action including warnings, suspension, or termination of access.

You retain ownership of content you provide, but you grant us a limited, worldwide license to host, process, transmit, and display that content as needed to operate the service—including for moderation, safety, and compliance with law.

You are solely responsible for your conduct and what you choose to share on camera or in any chat features. We are not a party to disputes between users.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. Random matching means you may encounter people or content you find objectionable; you use the service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUSHYCHAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) WHERE NO FEES APPLY, ONE HUNDRED U.S. DOLLARS (OR LOCAL EQUIVALENT), UNLESS MANDATORY LAW PROVIDES OTHERWISE.

We may update these terms periodically. We will post the revised version on this page and update the effective date. If a change is material, we will take reasonable steps to notify you where the product allows. Continued use after the effective date of changes constitutes acceptance of the updated terms, except where prohibited by law.

These terms are provided in English. If translated, the English version prevails in case of conflict, to the extent permitted by law.
